It turns out that it wasn't a "suicide" after all. A 19 year old was arrested and charged with second degree murder. Awful news.

NEW YORK (AP) -- A construction worker was arrested Monday and charged with murder in the death of an actress who was found hanging from a shower rod in the bathroom of an apartment she was renovating.
Police charged Diego Pillco with second-degree murder in the Manhattan slaying of Adrienne Shelly, Detective Kevin Czartoryski said. Pillco, 19, was picked up early Monday and was questioned for several hours until "he made statements," said Czartoryski, who would not say what the statements were.
Pillco, from Ecuador but living in Brooklyn, was expected to be arraigned Tuesday on the second-degree murder charge, a spokeswoman for the Manhattan district attorney's office said.

There was no home telephone listing for Pillco.

Shelly, who appeared in the movie "Factotum" last year, was renovating the inside of the Greenwich Village apartment she used as her residence and office. Pillco, one of the workers, was one of the last people seen going into her apartment, police said.
Shelly, whose birth name was Adrienne Levine, was found Wednesday at about 6 p.m. hanging from a shower rod over the bathtub in her apartment. Police were hesitant to label the case a suicide, observing that no note was found and sneaker prints that did not match Shelly's shoes were recovered from the bathtub.
A spokeswoman for the medical examiner's office, Ellen Borakove, said late Monday that her agency had not determined the cause of Shelly's death, whether by strangulation or other means, or whether it was a homicide.
Shelly, who was born in Queens and grew up on Long Island, was raising a 3-year-old daughter, Sophie, with her husband, Andy Ostroy.
"My wife's senseless death is devastating to me, our families and friends," Ostroy said Monday in a statement. "We are incredibly grateful to the New York City police department for their dedication, professionalism and tenacity in following up on every lead in this case."
Shelly, 40, was best known for her roles in the Hal Hartley films "The Unbelievable Truth," in which she played Audry Hugo in 1989, and "Trust," in which she starred as Maria Coughlin in 1990. She also appeared as Jerry in "Factotum" with Matt Dillon.
She worked steadily during her career in film, theater and television but later turned to writing and directing, making her directorial debut with "Sudden Manhattan" in 1996. She recently wrote and directed the film "Waitress," starring Keri Russell and Nathan Fillion.

Diego Pillco was arrested and charged with second-degree murder on Monday, according to New York Police Detective Kevin Czartoryski. Media reports speculated that Shelly had likely committed suicide, however, police had not ruled out foul play. No note was found at the scene of her death, and shoe prints did not match her shoes that were found in the apartment's bathtub. Shelly allegedly complained about construction noise in her Greenwich Village apartment building and had an argument with Pillco, who allegedly hit her, according to reports. The 19-year-old suspect was picked up early on Monday and was questioned for several hours until "he made statements," Czartoryski said. He did not elaborate on the nature of the statements. Shelly, 40, was born Adrienne Levine in Queens, New York and raised on Long Island and was best know for her appearances in the Hal Hartley movies The Unbelievable Truth and Trust. She and her husband, Andy Ostroy, have a three-year-old daughter named Sophie.

At about 5:45 p.m on Nov. 1, 2006, Shelly's husband found her hanging by a bedsheet[12] from a shower rod in the bathtub [11] of an Abingdon Square apartment in the West Village section of Manhattan's Greenwich Village.[12] Shelley, who lived in Tribeca,[11] used the apartment as an office and sublet it as a domicile to a friend.[11] Ostroy had dropped her off at between 10 and 10:30 a.m. that day, and as the building's doorman told journalists, "He hadn't heard from her and he said it was odd not to hear from her, so he was nervous. And he asked me to go up to the apartment with him, so we went to the front door, and it was unlocked".[11]

An autopsy was performed the following day. The New York City Police Department were suspicious of shoe prints in the bathtub that did not match Shelly's shoes. Shelly's husband also indicated that there was money missing from Shelly's wallet.[13]

Press reports on Nov. 6 stated that police had arrested construction worker Diego Pillco, 19, an illegal immigrant from Ecuador, who allegedly confessed to killing Shelly after she complained about the noise he was making in the building. Police said Pillco had made videos implicating himself in the murder, and as of Nov. 7 was being held without bail for her murder.[14] [15]

A teenage Ecuadorean construction worker has admitted killing Adrienne Shelly, an actor who made her mark in films by Hal Hartley, in an angry exchange over noisy building renovations. Shelly, 40, who made her last appearance alongside Matt Dillon in last year's Factotum, was found dead last week in the Manhattan apartment that she used as an office.Diego Pillco, 19, confessed under questioning that he fought with Shelly, tied a sheet around her neck, dragged her to the bathroom and hung her from the shower rod.

Shelly's body was discovered by her husband, Andy Ostroy, on November 1. Police had been hesitant to label the case a suicide, observing that no note was found and that trainer prints that did not match Shelly's shoes were recovered from a toilet seat.


Police said that Pillco had been working in an apartment located directly below Shelly. Under questioning, Pillco told them that Shelly had confronted him over noise emanating from the apartment and threatened to call the police. Pillco is then reported to have followed Shelley, pleading with her not to report him before grabbing her as she tried to enter her apartment. She tried to slap him away, and he responded by punching her in the head, a blow he said killed her.


Pillco is then reported to have claimed to hang the body in order to cover his tracks and make the slaying appear to be a suicide. But prosecutor Marit Delozier said there were no signs of serious head trauma. "This woman did not die from a strike to the head," she said. "The (medical examiner) has made it crystal clear that the victim died from compression to the neck."


Pillco was ordered held without bail pending a hearing tomorrow.
